These Terms govern the use of the Vitre platform, offered by TGMM LTDA, registered under CNPJ 32363859000151,
contact email [email protected]. By creating an account, you declare that you have read, understood, and
agree to the conditions below.
1. What Vitre is
Vitre is a software platform that allows the Merchant to create and maintain a digital storefront at their own
address (usevitre.com/your-store), with a product catalog and a virtual customer service assistant.
Vitre does not intermediate sales. We do not process payments between the Merchant and the consumer, we are not a
party to the purchase and sale relationship, we do not take possession of the products, and we do not participate in
delivery. Negotiation, billing, tax issuance, delivery, exchanges, and warranties are the sole responsibility of the
Merchant.
2. Account and Merchant responsibility
2.1. The Merchant must provide true information and keep their email and contact details up to date.
2.2. The Merchant is solely responsible for everything they publish: texts, images, prices, deadlines, descriptions,
and contact information.
2.3. The Merchant declares that they hold the necessary rights over the images, trademarks, and texts they publish,
and is liable for any infringement of third-party rights.
2.4. The Merchant is responsible for complying with the legislation applicable to their activity, including the
Consumer Protection Code, tax obligations, and any licenses required for the products they sell.
2.5. Access credentials are personal and non-transferable.
3. Data
3.1. Vitre processes personal data in accordance with the LGPD (Law 13.709/2018).
3.2. Regarding the data of consumers who interact with the store, the Merchant acts as the controller and Vitre as
the processor, processing such data only to enable the operation of the platform.
3.3. Conversations with the virtual assistant may be processed to generate responses and may be recorded in
aggregated form for service improvement.
3.4. The Merchant must not request, through the store chat, sensitive data, full credit card numbers, passwords, or
identity documents from consumers.
3.5. After account termination, the store data remains available for export for 30 days and may be permanently
deleted after that period.
4. Prohibited content
It is forbidden to publish, advertise, sell, or promote on the platform:
a) Illegal and regulated items
Illegal drugs, narcotics, chemical precursors and associated paraphernalia; medicines, anabolic steroids,
weight-loss pens and controlled-use products without proper legal authorization; firearms, ammunition, explosives,
restricted-use bladed weapons and their components; products that require registration with ANVISA, INMETRO or
ANATEL without valid registration; alcoholic beverages and age-restricted products without adequate age
verification; cigarettes, vapes, essences and tobacco derivatives; live animals, parts of wild animals and products
from protected species; documents, diplomas, certificates, accounts and access credentials.
b) Fraud and intellectual property
Counterfeit products, replicas or products that infringe trademarks, patents or copyrights; stolen, robbed, received
or products of unproven origin; pirated software, media, courses and digital content; pyramid schemes, multi-level
marketing, guaranteed income promises, betting, crypto-assets with yield guarantees and “name-clearing” services.
c) Sexual content and protection of minors
Pornography, sexually explicit material and escort services; any content involving the sexualization of minors — in
which case the account is immediately terminated and the fact is reported to the competent authorities.
d) Speech and safety
Content that promotes violence, hate or discrimination based on race, color, ethnicity, religion, origin, gender,
sexual orientation, age or disability; apology for criminal acts or for organizations that commit them; material
that exposes, threatens or harasses a specific person.
e) Health and misleading information
Products or treatments with promises of cure, miraculous weight loss or guaranteed health results; medical
misinformation that may cause harm.
f) Improper use of the platform
False prices, deadlines or availability; instructing the virtual assistant to lie, promise what the store does not
deliver, or pass itself off as a human when directly asked; inserting malicious code, attempting to access data from
other stores, overloading the infrastructure or bypassing technical limits; using the store for purposes unrelated
to the sale of lawful products and services.
5. Store address (slug)
5.1. The address usevitre.com/your-store is a license of use, not the property of the Merchant.
5.2. Vitre may refuse or change addresses that reproduce third-party trademarks, suggest a non-existent relationship
with a person or company, are offensive, or conflict with reserved areas of the platform.
5.3. Addresses of unconfirmed or terminated accounts become available again.
6. Moderation and suspension
6.1. Vitre does not pre-review published content. Responsibility for publication lies with the Merchant.
6.2. Vitre may, at any time and at its discretion, remove content, suspend or terminate a store that violates these
Terms or the law, with notice to the Merchant via the registered email.
6.3. In cases of serious and immediate risk — criminal content, exposure of minors, court order, risk to the
security of the platform or of third parties — suspension may be immediate and without prior notice.
6.4. Reports may be sent to [REPORT EMAIL], indicating the store address and the content in question. We will
analyze them within 5 business days.
6.5. A suspended Merchant may contest via the same email. If the suspension is reversed, the store is restored and
the suspended period is compensated in the subscription term.
6.6. Suspension for violation does not generate a right to a refund of the period already paid.
7. Subscription, payment and cancellation
7.1. Use of the platform depends on a monthly subscription of R$ 69.00, charged for the contracted period.
7.2. Payment is processed by a partner payment institution. Vitre does not store full credit card data.
7.3. Failure to pay suspends access to paid features after the due date and the tolerance period indicated in the
panel. Store data is preserved in accordance with clause 3.5.
7.4. The Merchant may cancel at any time via the panel or by email. Cancellation stops subsequent renewals; the
period already paid remains available until the end. There is no penalty or lock-in period.
7.5. Price adjustments will be communicated with 30 days’ notice and apply from the following renewal.
8. Availability and limitation of liability
8.1. Vitre makes efforts to keep the service available, but does not guarantee uninterrupted or error-free
operation. There may be interruptions due to maintenance, third-party failures or events beyond our control.
8.2. The virtual assistant is an automated resource that may produce inaccurate responses. It does not replace human
service and its responses do not constitute a binding offer. It is the Merchant’s responsibility to review their
catalog and confirm sales conditions with the consumer.
8.3. Vitre is not liable for lost profits, loss of opportunity or indirect damages.
8.4. To the maximum extent permitted by applicable law, Vitre’s total liability is limited to the amount paid by the
Merchant in the 12 months preceding the event.
8.5. The Merchant undertakes to hold Vitre harmless from third-party claims arising from content they published or
products they sold.
8.5. The Merchant undertakes to hold Vitre harmless from any third-party claims arising from content they published
or from products they sold.
9. General provisions
9.1. These Terms may be updated. Relevant changes will be communicated by email with 15 days’ advance notice.
Continued use after that period implies agreement.
9.2. The invalidity of any clause does not affect the remaining ones.
9.3. These Terms are governed by Brazilian law. The courts of the judicial district of [Curitiba/PR] are hereby
elected, without prejudice to the consumer’s right to file a claim in their own domicile.Contact:
